Abstract:

Diplomová práce se zabývá započtením na dědický podíl a povinný díl neboli institutem kolace a okrajově také zřeknutím se dědictví. Autorka analyzuje téma z hlediska hmotněprávní roviny rozborem vývoje institutu kolace. Cílem této práce je vytvoření komplexní odborné literatury a zodpovězení daných otázek. Danými otázkami jsou, zdali je aktuální právní úprava dostatečná a zdali je dostatečně zaručeno právo zůstavitele na rozhodnutí o svém majetku a právo pozůstalých na pozůstalost. V práci jsou nejdříve rozebrány základní pojmy a následně proveden historický exkurz, nastíněny úvahy de lege ferenda a také rozbor vybrané dostupné judikatury na dané téma.

Abstract:

This diploma thesis focuses on the Credit to Indefeasible and to Inheritance and little bit on the abandonment of an inheritance. The author analyses the topic in terms of a substantive plane. The objective of this thesis is to provide a comprehensive framework in which the following issues, in particular, are evaluated namely: whether the current legislation is sufficient and whether current legislation provides adequate protection to a testator to choose how to dispose of his or her property as well as the testator´s beneficiaries to inherit the said property. The first part of this thesis explores the fundamental terms, then proceeds to analyse and compare both current and historical legislation. Furthermore, this thesis provides an outline and an evaluation of the de lege ferenda principle, with the author´s proposed solution. Finally, the author analyses the accessible judicature of author´s own choice.
