Political Theory of Immigration: Possibilities and Limitations of Normative Analysis

Abstract:

Dizertační práce se věnuje imigraci a její regulaci. Text ukáže a bude analyzovat některé argumenty dvou typů přístupů k regulaci. Zatímco první přístup dává přednost svobodě pohybu s omezenou nebo žádnou restrikcí, druhý zdůrazňuje, že státy potřebují omezit imigraci. Abychom zhodnotili jejich tvrzení, budou prozkoumány různé empirické studie zabývající se touto problematikou. Zvláštní pozornost bude věnována představě, že lidé migrují především proto, že jsou chudí a pronásledovaní. Pokud by to bylo opravdu tak, měli bychom se zabývat především tím, jak bychom mohli řešit jejich problémy a tímto způsobem redukovat množství imigrantů, kteří jsou nuceni migrovat. Argumentace uvedená v této dizertační práci vede autora k přesvědčení, že i když existuje množství relevantních argumentů, proč by stát neměl jednostranně regulovat imigraci (nahodilost státních hranic, monopolizace využívání nerostných surovin, přehlížení možných škod imigrantů atd.), svobodná migrace bez omezení není možná (kvůli potencionálním negativním konsekvencím, i když autor se nedomnívá, že imigrace nemusí mít negativní důsledky). Proto, když se imigrant rozhodne dobrovolně migrovat, stát není povinen jej přijmout. Vlády by však měly uplatňovat restrikci jen v případech, kdy existují skutečné problémy nebo hrozby. A věřím, že státy by měly pomáhat pronásledovaným lidem v co největší míře, protože mohou být ohroženi na životě, pokud nebudou přijati. Nemůže-li stát pomoci, měl by hledat jiný způsob, jak je podpořit.

Abstract:

This doctoral thesis deals with immigration and its regulation. The text will show and analyse several arguments of two kinds of approaches to regulation. While the first one prefers free movement with limited or no restrictions, the second one emphasizes that states need to restrict immigration. To evaluate their claims, it will be examined various empirical studies on the issue. I will aim our effort especially to the idea that people migrate mainly because they are poor or persecuted. If this were true, we should examine what we could do to resolve their problems and thus reduce the number of immigrants who are forced to migrate. The argumentation presented in the doctoral thesis leads the author to believe that even if there are a lot of relevant arguments why state should not regulate immigration unilaterally (contingency of state borders, monopolization of exploitation of raw materials, ignoring the potential damage caused to immigrants, etc.), the free movement without restriction is not possible (because of potential negative consequences even if the author does not assume that immigration must have negative implications necessarily). Therefore, if an immigrant decides to migrate voluntarily, a state is not obligated to receive her or him. However, governments should restrict immigration if there are real problems or threats. And I believe that states should help refuges as much as possible because they can even die if we do not receive them. If a state cannot help all persecuted people, it should seek a way to support them differently.
