The legal nature and tasks of the consents in the Building Act

Abstract:

Práce se zabývá souhlasy podle stavebního zákona. Pozornost je věnována vymezení charakteristických znaků jednotlivých forem realizace činnosti veřejné správy, přičemž tyto jsou následně komparovány s právní povahou souhlasů, resp. se závěry správních soudů či názory odborné veřejnosti. V práci je zkoumán smysl a účel zavedení souhlasů do právní úpravy veřejného stavebního práva, stejně jako reálný odraz tohoto institutu v praktickém životě. Pozornost je rovněž zaměřena na postavení osob, které mohou být dotčeny existencí souhlasů, možnostem ochrany veřejných subjektivních práv či možnostem kompenzace vzniklé újmy. S právní povahou souhlasů nedílně souvisí i otázka, zda a jakým způsobem je možné přezkoumat souhlasy v rámci správního soudnictví.

Abstract:

The dissertation thesis deals with consents under the Building Act. Attention is paid to a measure of characteristic features of particular forms of public administration activities. These forms are compared with legal nature of the consents, respectively with the conclusions of the administrative courts or the opinions of the professional public. The thesis explores the meaning and purpose of introducing the consent to the legal regulation of the public construction law, as well as the real reflection of this institute in practical life. Attention is also paid to the status of persons who may be affected by the existence of the consents, to the possibilities of protecting public subjective rights or to the possibilities of compensating for the resulting harm. The legal nature of the consents is integrally related to the question of whether and how the consents can be reviewed by the administrative judiciary.
