Parental conflict in mediation over the care of minors

Abstract:

Diplomová práce Rodičovský konflikt v mediaci o péči o nezletilé děti se zabývá diskurzy, které klienti mediace vytvářejí a jak tyto diskurzy přispívají k možnosti dohody či nedohody. Pro tento typ práce byl využit kvalitativní výzkum pomocí případové studie. Sběr dat byl proveden formou nezúčastněného pozorování komunikace tří párů respondentů, klientů mediace, které bylo fixováno na audio záznam. Jako metoda analýzy dat byla využita diskurzivní analýza. Výsledky výzkumu představují dva nadřazené diskurzy, a to diskurz soupeření, které se objevilo u dvou ze tří případů, a diskurz spolupráce, u jednoho ze tří případů. Těmto nadřazeným diskurzům daly vznik vynořené hlavní diskurzy vytvářené klienty v rámci pozorovaného prvního mediačního sezení. Diskurz soupeření je podmíněný diskurzy požadavku spravedlnosti, přijetí odpovědnosti, souboje, požadavku uznání práv, neústupnosti a útoku. Diskurz spolupráce je pak podmíněný diskurzy otevřeného a podporujícího vztahu mezi rodiči, přátelským sdílením mezi rodiči, souladu rodičů a otevřené komunikace. Výsledky dále ukázaly, že vznik těchto diskurzů a stejně tak předpoklad možnosti dosažení mediační dohody či nedohody je podmíněn utvářenými konstrukcemi druhého partnera každou stranou v daném páru, které ovlivňují také interakci mezi nimi.

Abstract:

The master thesis Parental conflict in mediation over the care of minors examines the discourses that mediation clients create and how these discourses contribute to the possibility of agreement or disagreement. Qualitative research using a case study approach was used for this work. Data collection was conducted through non-participant observation of three couples of respondents, mediation clients, which was fixed on audio recording. Analysis of data was then executed by discoursive analysis. The results of the research present two superior discourses, namely the discourse of competition, which appeared in two of the three cases, and the discourse of cooperation, which appeared in one of the cases. These superior discourses gave rise to the emerging master discourses created by the clients in the first observed mediation session. The discourse of competition is conditioned by the discourses of demanding justice, accepting responsibility, fighting, demanding recognition of rights, intransigence and attack. The discourse of cooperation is then conditioned by the discourses of open and supportive relationship between parents, friendly sharing between parents, parental compliance and open communication. The results further showed that the emergence of these discourses, as well as the assumption of the possibility of reaching a mediation agreement or disagreement, is conditioned by the constructions of the other by each party in the couple, which also influence the interaction between them.
