The Sentencing of Legal Entities

Abstract:

Tématem bakalářské práce je problematika sankcionování právnických osob. Práce se zaměřuje na tresty a ochranná opatření, které mohou být ukládány právnickým osobám. Hlavní část práce obsahuje analýzu jednotlivých druhů sankcí, problematiku jejich ukládání a příklady jejich ukládání ze soudní praxe. Cílem práce je snaha zjistit, zda jsou existující sankce dostatečné pro potrestání právnických osob a v jaké míře jsou v praxi využívané. Výsledkem bakalářské práce je zjištění, že současné druhy trestů a ochranného opatření jsou pro náš právní systém dostačující, avšak zároveň je nutno podotknout, že u některých druhů trestů je třeba přistoupit ke změnám v právní úpravě.

Abstract:

The theme of the thesis is the issue of sentencing a legal entities. The thesis focuses on punishment and protective measures that can be imposed for legal entities. The main part of the thesis contains an analysis of the various types of sanctions, the issue of imposing and examples of imposing from judicial practice. The aim of the thesis is to determine whether existing sanctions are sufficient scope for punishment of legal entities, and to what extent they are used in practice. The result of this work is the finding that the current types of punishments and protective measures for our legal system are sufficient, but it would be appropriate to make changes in legal regulation of some types of sentences.
