Vertical Restraints: Resale Price Maintenance

Abstract:

Předmětem diplomové práce „Vertikální dohody: Omezení cen pro další prodej“ je komparace ekonomické teorie minimálních a maximálních cenových omezení s praxí antimonopolních úřadů, konkrétně Komise. První část obecně popisuje „resale price maintenance“, její historii a pohled antimonopolních úřadů Spojených států, Evropské unie a České republiky. Druhá část práce se zaměřuje na podrobný popis přístupu a zásad Komise k vertikálním dohodám se důrazem na „resale price maintenance“. V dalších částech analyzuji pozitivní a negativní účinky této vertikální dohody, které dále porovnávám právě se zásadami Komise. Ta věnuje velkou pozornost v Pokynech k vertikálním omezením tržním podmínkám a struktuře na trhu. Proto se i já dále v práci soustředím na otázku vlivu těchto faktorů. Na vlastním modelu, kde beru v úvahu tržní sílu a diferenciaci produktu, dokazuji při daných podmínkách modelu jejich důležitost.

Abstract:

The subject of this thesis „Vertical restraints: Resale price maintenance“ is comparison of the economic theory of minimal and maximal price restraints with the antitrust office’s practice, in particular the Commission. The first part describes resale price maintenance in general, its history and the view of antitrust offices of the United States, European Union and the Czech Republic. The second part focuses on detailed description of the Commission’s attitude and principals to vertical restraints with an emphasis on resale price maintenance. In other parts the thesis deals with positive and negative effects of the vertical restraints, which are compared with the Commission’s rules. The Commission in Guidelines on Vertical restraints lays stress on market conditions and structure. This is the reason why the thesis is focused on influence of these factors. Using my own model (in which I take into the concideration the market strenght and the product diferenciation) I prove (using set conditions of the model) its importance.
