Legislation of the general use of the forest

Abstract:

Hlavním cílem této diplomové práce je uvedení do problematiky obecného užívání lesa, a to zejména v souvislosti s přesným vytyčením práv a povinností souvisejících s tímto právním institutem. Současně však patří mezi cíle komparace polské právní úpravy s českou právní úpravou, neboť právě porovnání slouží k lepšímu pochopení této problematiky. Diplomová práce je rozdělena do šesti hlavních kapitol. V rámci první kapitoly jde o vymezení pojmu les, neboť právě to představuje základ pro pochopení podstaty této diplomové práce. Následující kapitola pojednává o problematice veřejného užívání, a to z toho důvodu, že obecné užívání lesa je představitelem základní kategorie veřejného užívání, tj. obecného užívání. V rámci třetí a čtvrté kapitoly jde jak o charakteristiku, tak o stanovení práv a povinností v rámci obecného užívání lesa, a to zejména dle zákona č. 289/1995 Sb., lesního zákona. Pátá kapitola pojednává o právní odpovědnosti v rámci obecného užívání lesa, neboť je důležité vědět, co následuje po porušení stanovených pravidel. Poslední kapitola je věnována komparaci polské právní úpravy s českou právní úpravou.

Abstract:

The main aim of this thesis is to introduce the issue of general forest use, especially in connection with the precise definition of rights and obligations related to this legal institute. At the same time, however, it is among the objectives of comparing the polish legislation with the czech legislation, as it is precisely the comparison that serves to better understand this issue. This thesis is divided into six main chapters. Within the first chapter it is a matter of defining the concept of forest, as this is what constitutes the basis for understanding the substance of this thesis. The following chapter discusses the issue of public use, on the grounds that general forest use is representative of the basic category of public use, i. e. general use. Under the third and fourth chapters, it is both a characteristic and a determination of rights and obligations in the context of the general use of the forest, in particular under Act No. 289/1995 Coll., forest act. The fifth chapter deals with legal liability in the context of general forest use, as it is important to know what follows a breach of the established rules. The final chapter is devoted to comparing the polish legislation with the czech legislation.
