Insolvency Proceeding with an Employee

Abstract:

Tématem bakalářské práce je insolvenční řízení u zaměstnance. Cílem práce je zhodnotit systém insolvenčního řízení z pohledu dlužníka, dopady na jeho příjmy a vyhodnotit důsledky pro zaměstnavatele. V teoretické části jsou vymezeny základní pojmy a právní předpisy se zaměřením na vybraný způsob oddlužení, a to plněním splátkového kalendáře se zpeněžením majetkové podstaty. V praktické části je zhodnocen vývoj v oblastech exekucí a insolvencí v rámci České republiky. Na příkladech dlužníků příspěvkové organizace v Moravskoslezském kraji je vymezen průběh a dopad oddlužení a exekuce a jsou porovnány změny před a po účinnosti novely insolvenčního zákona. V práci jsou popsány povinnosti zaměstnanců mzdového oddělení v případě nástupu zaměstnance, který je zatížen exekucí nebo insolvencí. Bakalářská práce upozorňuje, v kontextu exekuce či insolvence zaměstnanců, na značnou administrativní zátěž u zaměstnavatelů a na dodatečné povinnosti, které jim ukládají právní předpisy.

Abstract:

This bachelor thesis deals with insolvency proceedings in employees. The aim of the thesis is to assess the system of insolvency proceedings from the debtor’s viewpoint, the impact on their income and to evaluate the consequences for the employer. In the theoretical part, basic terms and legislation aimed at a particular way of debt discharge in accordance with the debt repayment schedule, including selling goods are discussed. The practical part focuses on the development in the area of insolvency and enforcement of judgment in the Czech Republic. The course and impact of discharge and enforcement of judgment are demonstrated on examples of debtors from one subsidized organization in the Moravian-Silesian Region, including the comparison of the changes before and after the amendment to the insolvency law. Furthermore, the duties of payroll department staff are described if an employer burdened with execution or insolvency is admitted. In this context, the thesis points out substantial administrative strain in employers as well as additional duties following from legislation.
