Entrepreneur as the „Weaker" Conctracting Party in Contractual Obligations

Abstract:

Tato práce se zabývá postavením podnikatele jako „slabší“ strany. V práci je věnována pozornost zásadám týkajících se „slabší“ strany a ustanovením, ve kterých je „slabší“ strana reflektována. Zejména se však zkoumá, za jakých podmínek lze podnikatele za „slabší“ stranu označit. Tyto podmínky se různí svým druhem i důležitostí, kdy základní rozdělení je na relativní a objektivní kritéria. Dochází se k názoru, že téma práce je komplexním problémem, práce dává na tento problém základní náhled.

Abstract:

This thesis' concern is about possibility of entrepreneur beeing a „weaker“ party in a contract law. The thesis pay attention to principles of civil law concerning „weaker“ party and to articles, which include „weaker“ party. Most importantly, the thesis research at what conditions is possible to call a party the „weaker“ one. The conditions vary, basic sorts are objectives ones and relative ones. The conclusion of thesis is, that this problem is quite complex, so the thesis provides basic insight into the problem.
