Some Aspects of International E-commerce in Wiew of Payment

Abstract:

Práce se zabývá vybranými aspekty mezinárodního elektronického obchodování. Kapitola "Základní koncepční východiska e-obchodování" obsahuje základní rozdělení e-obchodních vztahů a dále problematiku zvláštního virtuálního prostoru především počítačových sítí, ve kterém se mezinárodní e-obchod realizuje. Pro tento virtuální prostor byl přijat termín "kyberprostor" jako právně-sociologický konstrukt umožňující efektivní popis, analyzování a modelování právních vztahů a normativních systémů, v souvislosti s mezinárodním e-obchodem. Další kapitola rozebírá právní regulaci mezinárodního e-obchodování. Nejdříve je popsán touto prací ad hoc vytvořený systém práva mezinárodního e-obchodu, dále je právní regulace strukturována podle jejích pramenů. Systém je rozdělen do části obecné obsahující společnou a obecnou úpravu mezinárodního e-obchodování (např. univerzální mezinárodní úmluva) a dále do části zvláštní obsahující úpravu partikulárních subsystémů (např. platební systémy). Obecná část se např. dotýká problematiky funkcionální ekvivalence listin a datových zpráv a listin, "klasického" podpisu a podpisu elektronického. Rovněž je zmíněna otázka mezinárodní pravomoci vnitrostátních soudů. Tato problematika je doplněna judikaturou. Část zvláštní potom zejména platebními systémy. Regulace elektronického obchodování v EU je postavena samostatně a není systémově zařazena ani do obecné, ani do zvláštní části mezinárodního e-obchodního práva. Poslední závěrečná kapitola shrnuje poznatky do závěrečných tezí a možnostmi jejich dalšího praktického využití.

Abstract:

The thesis is concerned with the selected aspects of the international eCommerce. The chapter called "Fundamental conceptual cornerstones of eCommerce" contains the division of the eCommerce relationships and further the issues of the particular virtual space primarily of the computer networks, where is the international eCommerce realized in. For this virtual space was introduced the term "cyberspace" as a legal and sociological construction enabling the efficient description, analysis and modelling of the legal relationships, and the normative frameworks connected with the international eCommerce. The next chapter analyses legal regulation of the international eCommerce. Firstly, the ad hoc created system of the law of international eCommerce by this paper is described, further structuring is done according its sources. The system is divided into a general part containing the regulation of the common issues (e.g. the universal treaty), and into the special part dealing with the regulation of the particular subsystems (e.g. payment systems). The general part deals with e.g. the issues of the functional equivalence of documents and data messages, and "classical" signature and the electronic signature. As well is mentioned the question of the international jurisdiction of the domestic courts. These issues are supplemented by the appropriate cases. The special part is in particular concerned with the payment systems. The regulation of the eCommerce in EU is discussed separately, and it is not build in either into the general part or into the special part of the international eCommerce law. The conclusion summarizes the findings into the final thesis, and discusses the capabilities of their further exploitation.
