Apprehension from the Point of View of Criminal Substantive Law and Criminal Procedure

Abstract:

Ve své diplomové práci jsem se zabýval navýsost aktuálním a velice zajímavým tématem. Chtěl bych na tomto místě vyjádřit radost z faktu, že jsem se tomuto tématu mohl věnovat. Tímto tématem, o němž zde hovořím, je institut zadržení pojímaný z hlediska hmotněprávního, ale též procesněprávního. Z hmotněprávního hlediska byly mým tématem okolnosti vylučující protiprávnost a všechny otázky, jež s nimi souvisejí, zmínil jsem se též o konsekvencích souvisejících s těmito okolnostmi a vznikem škody. Z hlediska procesněprávního jsem se pokusil rozebrat institut zadržení z úhlu jednotlivých jeho variant, tedy zadržení osoby podezřelé ze spáchání trestného činu, zadržení obviněného a tzv.: občanské zadržení. Zaměřil jsem se také na ústavněprávní a mezinárodněprávní projevy institutu zadržení. Pokusil jsem se také, ač v krátkosti, zmapovat historický vývoj institutu zadržení na našem území, jeho projevy a vztahy s dalšími trestněprávními instituty. Zabýval jsem se také srovnáním jednotlivých zahraničních úprav v porovnání s úpravou naší. Zaměření srovnávací analýzy bylo zde zacíleno na středoevropský region a jeho nuance v jednotlivých státech. Pokusil jsem se mimo jiné zaujmout stanovisko k tomuto tématu také z hlediska nově připravovaného trestního zákoníku a vyjádřit se k dané problematice i de lege ferenda. Názor nakolik se mi to povedlo, či nepovedlo nechť posoudí laskavý čtenář.

Abstract:

I dealt with a very up-to-date and an interesting subject in my diploma work. I would like to express pleasure I could work on this subject. The subject I speak about is the institute of detention from the substantive and procedural point of view. I considered the circumstances excluding the illegality of an act from the substantive point of view and all other questions connected to them. I also mentioned the consequences related to these circumstance and the occurence of damage. I tried to regard the subject from the procedural point of view by analyse the institute separately from its varieties, like the detention of suspected person of committing a criminal act, detention of an accused person and so called „civil detention“. I focused on constitutional and international means of the institute of detention. I as well tried, even shortly, to cover the historical development of the institute of detention on our teritory, his relevance and relations with other criminal law institutes. I dealt with the comparism of foreign legal regulations to the Czech one. I focused the comparative analyses on the Middle European region and its differencies in certain countries as well. I tried to create an attitude towards this subject in „de lege ferenda“ field. I leave the judgement when I was succesfull or not on a gratefull reader.
