Group insurance and its regulation in Czech Republic

Abstract:

Diplomová práce se věnuje tématu skupinového (flotilového) pojištění v prostředí české právní úpravy, kdy pojištěnými jsou fyzické osoby. Práce objasňuje základní charakteristiku a zákonné prameny skupinového pojištění, neboli nabízení možnosti stát se pojištěným dle § 4 ZDPZ osobou v právním postavení pojistníka. Práce se dále zaměří na téma pojistného zájmu, které je zejména v oblasti skupinového pojištění zásadní z důvodu nepříliš podrobné zákonné úpravy tohoto institutu. Další zkoumanou oblastí je pak postavení pojištěného, tedy jeho odlišná pozice v režimu skupinového a individuálního pojištění. Cílem práce je porovnat regulatorní požadavky na distribuci produktů individuálního a skupinového pojištění, zejména pak zákonné povinnosti distributora při sjednání pojištění s přesahem do požadavků na odborné znalosti. Závěrem práce odpovím na výzkumnou otázku: „Je současná regulace distribuce skupinového pojištění v ČR dostatečná s ohledem na ochranu pojištěného klienta a v porovnání s regulací distribuce individuálního pojištění?“.

Abstract:

The diploma thesis describes the topic of group insurance in the environment of Czech legislation, where individuals are the insured. The thesis elucidates the basic characteristics and legal sources of group insurance, in other words the opportunity offering to become insured, under § 4 of the legal act transposing the Insurance Distribution Directive, by a person in the legal position of policyholder. Onwards, the work focuses on the topic of insurance interest, which is especially crucial in the area of group insurance due to its not very detailed legal regulation. Next explored area is the status of the insured, specifically their different status in the area of group and individual insurance. The aim of this thesis is to compare regulatory requirements of the individual and group insurance distribution, mainly legal obligation of the distributor with an overlap to expert knowledge requirements. By the end of the thesis I will answer the research question: „Is current group insurance distribution regulation in Czech republic sufficient in the scope of protecting the insured client compared with the individual insurance distribution regulation?“.
