Control activities of trade licensing authorities and administrative punishment in the field of trade business

Abstract:

Předkládaná diplomová práce je zaměřena na problematiku kontrolní činnosti vykonávanou živnostenskými úřady, které jsou základními kameny ve struktuře živnostenských úřadů v České republice. Trestní odpovědnost podnikatelů v souvislosti s jejich podnikáním vzniká a je výsledkem kontrolní činnosti živnostenských úřadů. Cílem této diplomové práce je na základě analýzy systému a procesů živnostenské kontroly a neoprávněného podnikání snažit se podnikatelům a i laické veřejnosti přiblížit nástroje, kterými disponují živnostenské úřady v rovině sankčních postihů a postupy živnostenských úřadů při řešení různých druhů přestupků, včetně toho, jakými úvahami a podklady se živnostenské úřady zabývají při posuzování výše sankce a na základě zrušeného oprávnění i případných překážek provozování živnosti.

Abstract:

The present thesis focuses on the issue of control activities carried out by trade licensing offices, which are the cornerstones of the structure of trade licensing offices in the Czech Republic. Criminal liability of entrepreneurs in connection with their business arises and is the result of the control activities of trade licensing authorities. The aim of this thesis is, on the basis of an analysis of the system and processes of trade control and unauthorized business, to try to make entrepreneurs and the general public aware of the tools available to trade authorities in terms of sanctions and the procedures of trade authorities in dealing with various types of offences, including what considerations and grounds the trade authorities deal with when assessing the amount of the sanction and, on the basis of the revoked authorization, possible obstacles to the operation of the trade.
