Abstract:

Práce má za úkol zhodnotit současnou právní úpravu zániku nájmu bytu upravenou předpisy českého právního řádu, za pomocí výkladu právních institutů a jejich vzájemných vztahů a dále za využití soudních rozhodnutí. Vedle jednotlivých způsobů zániku nájmu bytu jako dohoda účastníků, výpověď ze strany nájemce, uplynutí doby na kterou byl nájem sjednán, odstoupení ze strany nájemce nebo pronajimatele, atd., hodnotí práce též právní úpravu bytových náhrad a problematiku žalob na vyklizení bytu.

Abstract:

The work aims to evaluate the existing legal regulation of the termination of the lease of a flat that is governed by the regulations of the Czech legal order, with the use of interpretation of the juridical institutes and their mutual relations and with the use of judicial decisions. Besides individual ways of termination of the lease of a flat, such as an agreement of the participants, repudiation of the contract on the part of the tenant, expiration of term for which the lease was concluded, withdrawal from the contract on the part of the tenant or landlord, etc., the work also evaluates the legal regulation of the provision of compensations for loss of flat and the problems of petition for the vacation of the flat.
