The Remedies in the Aliens Law

Abstract:

Diplomová práce se zabývá problematikou opravných prostředků v cizineckém právu, konkrétně v zákoně 326/1999 Sb., o pobytu cizinců. Nejprve jsou obecně představeny instituty přechodného pobytu, trvalého pobytu, správního vyhoštění a zajištění. Násled-ně se práce zaměřuje na rozdíly v obecné úpravě opravných prostředků ve správním řádu a soudním řádu správním a zvláštní úpravě v zákoně o pobytu cizinců. Práce se soustředí na komplexní analýzu zmíněných institutů a na vymezení kladů a záporů zákonné úpravy a správní praxe a následně na možná doporučení pro změnu legislativy.

Abstract:

The diploma thesis is concerned with the issue of remedies in Czech Aliens law, specifi-cally in the code of residence of foreigners. First, the general institutes of temporary and permanent residence, administrative expulsion and detention of refugees are introduced. Subsequently, the thesis focuses on the differences in general adjustments of judicial remedies in administrative law and administrative procedure code with a specific provi-sion in the code of residence of foreigners. The thesis aims to comprehensively analyse the forementioned institutes and to specify the positive and negative aspects of the amending acts and administrative practice, and suggests possible changes in the legisla-tion.
