Judicial co-creating the Law

Abstract:

Práce analyzuje situace soudního rozhodování charakteristické vyšší mírou ingerence soudce a postupy, které k těmto zásahům mohou být využity. První kapitola porovnává jednotlivé právně filozofické a právně teoretické směry z hlediska jejich náhledu na postavení soudce. Uvedeno je taktéž základní srovnání s angloamerickou právní kulturou. Kapitola následující se zabývá situacemi, ve kterých může docházet k soudcovskému dotváření práva a skrze definici složitého případu aplikace práva uvádí, kdy k němu skutečně dochází. Následuje výklad o metodologických pravidlech, v těchto situacích povinně užívaných. Stěžejní část práce představuje kapitola čtvrtá, která shrnuje zjištění kapitol předchozích a na jejich základě popisuje meze soudcovského dotváření práva.

Abstract:

The present thesis addresses the judicial decision-making characterized by a larger extent of judicial intervention and the pertaining methods. The first chapter examines the philosophical and theoretical approaches in their legal perception of the status of a judge. Further, in this respect, a fundamental comparison with the common law legal culture is provided. The following chapter deals with situations where the judicial co-creating the law may arise and through the lens of a hard case shows when this actually takes place. Moreover, the methodological rules which are mandatory in these situations are explored. The fourth chapter is the cornerstone of the present thesis, which discusses the limits of judicial co-creating the law against the background of already presented findings.
