The Supreme Court of Justice and its Historic Role in the Constitutional System of the USA

Abstract:

První kapitola práce se zabývá ranou historií soudu a jeho postavení v rámci federálního soudního systému a jeho struktury . Krátce je zmíněno i americké právo (obecné právo, precedenty, stare decis a ius positum). Druhá kpitola se zabývá Ústavou USA, jejími články a pozměňovacími návrhy. Uvádím důvody, proč a jak se Ústava vyhnula nepříjemně trnité otázce doby - otroctví, které se ukázalo jako předmět mnoha soudních sporů u Nejvyššího soudu. Třetí kapitola definuje postoj soudního dvora stanovený Ústavou, jeho zřízení a ranou historií, jmenováním soudců a jejich pravomocemi. Nejvyšší soud se tak stal svrchovaným orgánem, který má pravomoc rozhodovat o jakýchkoli právních sporech v odvolací soudní pravomoci, což byl případ všech soudních sporů v poslední části této kapitoly, která poskytuje náhled na některé právní spory ať již zmíněného otroctví či jiné. Čtvrtá kapitola uvádí 13 hlavních soudců od samého počátku své existence až do první poloviny dvacátého století a závěrečná kapitola uvádí některé z jejich případů, kdy byla učiněna klíčová rozhodnutí. Prostřednictvím těchto rozhodnutí stanovil Nejvyšší soud pravomoc soudního přezkumu a výkladu ústavních článků a dodatků a také uvedl do života některé klíčové ústavní principy obsažené v obchodní doložce, smluvní doložce apod. Svými rozhodnutími Nejvyšší soud stanovil své postavení v ústavní systém samostatných pravomocí a stal se velmi silným hráčem v právní i politické sféře a strážcem Ústavy USA

Abstract:

The Supreme Court of Justice was founded under Article III of the Constitution, the major law of the country, which primarily emphasized the formation of system of separate powers executive, legislative and judicial. It also specified jurisdictions in the system of federal judiciary including the Supreme Court and coexistence between federal institutions and those ones of individual states. In the first chapter my thesis deals with the early history of the Court and its position within federal judicial system and its structure. It explains what the Americal law is based on what are its roots (common law, precedents, stare decis and ius positum). Here it also deals with the Constitution, its Articles and Amendments included in the Bill of Rights (I X), but also with those ones passed later that do not belong to the Bill (XI XXVII so far). It gives reasons why and how the Constitution avoided an indesputably thorny issue of the period slavery, which proved to be subject matter of many legal disputes to come and dealt with and decided mostly under appelate jurisdiction of the Court. The second chapter defines the Court's position as specified under the Constitution, its establishment and early history, appointment of justices and the chief justice, and also its direct jurisdictions. Thus the Supreme Court of Justice became the sovereign institution with authority to decide any legal disputes in appelate jurisdiction, which was the case in all litigations of the last part of this chapter that gives insight into some legal disputes centered around slavery issues and decided by the Court. Its controversial decisions escalated tensions in society divided over that issues and resulted in outburst of Civil War. The third chapter introduces selected 13 chief justices from the very beginning of its existence up to the first half of the twentieth century and the concluding chapter presents some of their cases where key decisions were made. Through those decisions the Supreme Court established the power of judicial review and interpretation of the constitutional Articles and Amendments as well as brought to life some key constitutional principles contained in commerce clause, contract clause etc. Through its decisions the Supreme Court established its position in constitutional systém of separate powers and became a very powerful player in both legal and political spheres and a guardian of the Constitution.
