Penal Protection of Industrial Property Law

Abstract:

Záměrem této práce je shrnout zejména trestněprávní problematiku průmyslových práv. Přestože je důraz kladen zejména na trestní právo, tak se práce nemůže vyhnout jiným právním odvětvím, vůči nimž má trestní právo působit subsidiárně. Práce nejdřív analyzuje a ustanovuje nejdůležitější instituty průmyslových práv, které jsou následovány historickým exkursem vrcholícím rozborem platné úpravy uvedené v trestním zákoníku. Následuje stručné shrnutí mimotrestní úpravy v návaznosti na subsidiaritu trestní represe a zvláštnosti související s trestním procesem v souvislosti s průmyslovými právy. Na závěr je poté uvedené stručné shrnutí poznatků a zamyšlení autora nad nedostatky trestněprávní úpravy s návrhy možných řešení.

Abstract:

The purpouse of this thesis is to summarize the issues of the penal perotection of industrial property. Even though the criminal law is the main portion, the paper can not avoid an attention to other legal branches, towards which the criminal law is a subsidiary. Firstly the work anylizes and establishes the most important institutions of the industrial property followed by the historical excursion topped by the the analysis of the valid law given in the penal code. The brief summary of non-penal branches of industrial property law in the connection to the subsidiarity of criminal repression and particuliarities related to the criminal proceeding in the context of industrial property follows. In the end the paper presents a brief summary of all findings and the reflection of author´s on the lack of penal protection of industrial property law with proposals of possible solutions.
