Abstract:

Tato diplomová práce se zaměřuje na téma Mezinárodních smluv v právu EU. Mezinárodní smlouvy jsou jediným možným závazným pramenem práva k úpravě vnějších vztahů a vyskytují v právu EU v hojném množství. Tato práce se snaží uvést jednotlivé druhy mezinárodních smluv vyskytujících se v právu EU a vyhodnotit u konkrétních druhů jejich specifika, dále se také věnuje rozboru a vyhodnocení pravomoci EU k uzavření těchto smluv, osvětlení možnosti dovolávat se jejich účinku v unijním právu a v neposlední řadě také kontrole slučitelnosti mezinárodních smluv s právem EU. Práce také obsahuje rozbor a vyhodnocení judikatury ESD týkající se tohoto tématu.

Abstract:

This diploma work focuses on the theme “International Treaty in EU Law”. The international treaties are the only one possible binding law resource for the external law formation and they abundantly appear in the EU law. This work focuses on particular types of international treaties appearing within the EU law. This work also aims to state the specifics of some of these types, further it also analyses and evaluates the EU competency when concluding these international treaties, there are possible explanations of their efficiency within the EU law and as well there is described the control when pooling them within the EU law. The work also concludes the analyses and assessments of the ESD judicature relating to this theme.
