Abstract:
Předkládaná diplomová práce se zabývá postavením poškozeného a jeho nárokem na náhradu újmy či vydání bezdůvodného obohacení. Stěžejní část je zaměřena na analýzu hmotněprávní a procesněprávní roviny adhezního řízení, včetně dopadů proběhlé rekodifikace soukromého práva. Presented diploma thesis deals with the status of aggrieved party and the right for compensation of damages or reclaiming unjust enrichment. The main part is focused on analysis of substantive and procedural law basis of adhesion process, including the impact of recent recodification of private law.
