Influence of the Case Law of the ECHR on the Case Law of the CJEU

Abstract:

Tato diplomová práce předkládá analýzu nejen judikatorního vlivu Evropského soudu pro lidská práva na Soudní dvůr Evropské unie v lidskoprávní oblasti, ale rovněž i celkového vztahu mezi oběma orgány v jednotlivých klíčových fázích institucionálního vývoje Evropské unie. Práce je proto rozčleněna do období před a po vstupu v platnost Lisabonské smlouvy a následně se zabývá následky vyvolanými očekávaným přístupem Evropské unie k Evropské Úmluvě o ochraně lidských práv a základních svobod. Vzájemné interakce jsou v diplomové práci zdokumentovány relevantními rozhodnutími obou soudů.

Abstract:

This diploma thesis analyses not only the judicatory influence of the European Court of Human Rights on the Court of Justice of the European Union in human rights area but also the overall relationship between both organs in particular stages of the institutional development of the European Union. Therefore, the thesis is divided in the periods before and after the Lisbon Treaty has come into force and deals with consequences prompted by the awaiting accession of the European Union to the European Convention for the Protection on Human Rights and Fundamental Freedoms. The relevant judgements of both courts document the mutual interactions.
