Good Manners in the Course of Europeization of Private Law

Abstract:

Téma mé diplomové práce představují dobré mravy jako základní zásada a významný institut českého právního řádu z hlediska vlivu procesu evropeizace soukromého práva na jejich další vývoj a možné uplatnění. Cílem je nalézt odpověď na otázku, zda budou mít dobré mravy i nadále místo v českém právním řádu anebo je bude nutné nahradit, či doplnit jiným právním institutem. Práce obsahuje analýzu dobrých mravů v českém právu de lege lata i de lege ferenda, charakteristiku a nástin vývoje evropeizace a analýzu mravního korektivu ve vybraných unifikačních projektech.

Abstract:

The aim of my thesis was to consider possibilities of further use of “good manners” in the Czech legal system with regard to the ongoing process of Europeanization of private law.I have analysed the status of good manners and marginally also the status of good faith in the Czech legal system in the past, thus both de lege lata and de lege ferenda. This analysis is comprises the first and second chapters. Chapters 3 and 4 go on to describe the process of Europeanization of private law with regards to its main problems and two possible ways in which this process is accomplished. Here I have also tried to find a moral corrective which fills the same or similar functions as good manners. The last chapter analyses the use of this corrective (good faith) in European private law (the Community Acquis and soft law).
