Usury and its prosecution after the First World War. Example of usury court in Olomouc.

Abstract:

Tato bakalářská práce se zaobírá analýzou lichevních přestupků vyšetřovaných Lichevním soudem v Olomouci mezi lety 1919 až 1924. Práce také přibližuje okolnosti a příčiny vzniku těchto speciálních soudů v poválečném Československu. Práce má za cíl čtenáři vysvětlit prostřednictvím analýzy vybraných soudních kauz chování státu vůči lichvě v těsně poválečném období. Stěžejním pramenem pro tuto práci jsou soudní spisy fondu Lichevní soud Olomouc. Úvodní kapitola kromě vytyčení definice lichvy představuje krátký historický exkurz tohoto fenoménu. Druhá kapitola se soustředí už na poválečné dění a kontext vzniku těchto soudů s jejich stručným popisem. Třetí kapitola je obecný popis zkoumaného vzorku, resp. badatelské sondy. Poslední kapitola je část praktická, tedy rozbor jednotlivých soudních kauz řešených olomouckým lichevním soudem napříč jeho fungováním.

Abstract:

This bachelor thesis deals with the analysis of usury offenses investigated by the Usury Court of Olomouc between 1919 and 1924. The thesis also outlines the circumstances and causes of the establishment of these special courts in post-war Czechoslovakia. Its aim is to explain to the reader, through the analysis of selected judicial cases, the state's behaviour towards usury in the immediate post-war period. The primary source for this work are the judicial records of the Olomouc Usury Court. The introductory chapter, besides defining usury, provides a brief historical overview of this phenomenon. The second chapter focuses on post-war events and the context of the establishment of these courts with their brief description. The third chapter provides a general description of the examined sample or research probe. The final chapter is the practical part, analysing individual judicial cases handled by the Olomouc Usury Court throughout its operation.
