An Analysis of the Current Status of Victims of Crime

Abstract:

Cílem mé diplomové práce je zjistit aktuální postavení oběti trestného činu. Analyzovat legislativní, kriminologické a sociální aspekty oběti, její postavení v průběhu trestného činu, po trestném činu, ale i v rámci vyšetřování a projednávání trestného činu. V teoretické části jsou vymezeny základní pojmy a formulovány definice daného problému. V praktické části jsou popsány výsledky mé práce. Je zde zpracována analýza postavení oběti a to ve všech aspektech právním, ekonomickém i sociologickém. Je zde zhodnocena role oběti v genezi trestného činu, reakce oběti na trestný čin, právní nároky oběti, možnosti pomoci oběti, včetně institucionální analýzy subjektů, které tuto pomoc poskytují. Vše je statisticky vyhodnoceno, zjištěné poznatky jsou zpracovány do názorných grafů a tabulek. V poslední části je zpracováno dotazníkové šetření, pomocí něhož jsem zjišťovala zkušenosti respondentů s kriminalitou, oznámení zločinu, informovanost o preventivních opatřeních i novém zákonu č. 45/2013 Sb. o obětech trestného činu. Závěrem jsou poznatky zhodnoceny do platných doporučení pro všechny, kdo se obětí trestné činnosti mohou stát.

Abstract:

The aim of my thesis is to determine the current status of the victim of the crime. Ana-lyze legislative, criminological and social aspects of victim, its status in the course of the crime, after the crime, but also during the investigation and hearing. In the theoretical part, basic concepts and definitions of the problem are formulated. In the practical part, results of my work are described. There is an analysis of the posi-tion of the victim in all aspects - legal, economic and sociological. Role of the victim in the genesis of the crime is evaluated, victim's reactions to the crime, victim's legal claims, assistance options including institutional analysis of entities that provide the assistance. Sta-tistical evaluation is processed and findings are put into illustrative graphs and tables. The last section contains a questionnaire through which I examined the experiences of crime, crime notifications, information on preventive measures and the new Act. No. 45/2013 Coll. on victims of crime. In conclusion, the findings are evaluated into valid recommendations for all those who could become victims of a crime.
