Abstract:

Tato bakalářská práce se zabývá problematikou obětí trestných činů a poškozených. Definuje pojmy týkající se dané problematiky, tzn. co je to poškozený, oběť, zvlášť zranitelná oběť, újma (majetková a nemajetková) apod. Důležitou oblastí, kterou tato bakalářská práce také upravuje, jsou práva obětí trestných činů a poškozených. Tato práva by samozřejmě byla k ničemu, pokud by je nešlo procesně uplatnit před soudem, o čemž je pojednáno v kapitole zabývající se adhezním řízením, tj. řízením o náhradě škody způsobené trestným činem. Další kapitola se zabývá prostředky pomoci obětem trestných činů a poškozeným. Dále jsou zde zmíněny také viktimologické aspekty, které jsou v této souvislosti také velmi důležité. Nakonec, v poslední kapitole, je uvedena komparace se zahraničím, konkrétně s právní úpravou obětí trestných činů a poškozených v USA a Spolkové republice Německo. Závěr této bakalářské práce shrnuje odpovědi na výzkumné otázky a hypotézy stanovené v úvodu této práce. Samozřejmě nechybí ani bibliografie, tj. seznam zdrojů, které byly při psaní této bakalářské práce využity.

Abstract:

This bachelor thesis deals with the issue of victims of crime and victims. Defines terms related to the issue, ie. what is the victim, the victim, a particularly vulnerable victim, harm (property and non-property), etc. An important area that this bachelor's thesis also regulates is the rights of victims of crime and victims. Of course, these rights would be useless if they could not be asserted in court before the court, which is discussed in the chapter dealing with adhesion proceedings, ie proceedings for compensation for damage caused by a criminal offense. The next chapter deals with means of assistance to crime victims and victims. Furthermore, victimological aspects are also mentioned here, which are also very important in this context. Finally, in the last chapter, a comparison is made with foreign countries, specifically with the legal regulation of victims of crime and victims in the USA and the Federal Republic of Germany. The conclusion of this bachelor thesis summarizes the answers to the research questions and hypotheses set out in the introduction of this thesis. Of course, there is also a bibliography, ie a list of sources that were used in writing this bachelor's thesis.
