Internal Governance of an Associaton

Abstract:

Diplomová práce se zabývá možnostmi, které přináší spolkové právo k úpravě vnitřních poměrů spolku. Celý problém je nahlížen v kontextu spolkové autonomie a jejich mezích stanovených kogentními ustanoveními občanského zákoníku. Práce se zaměřuje na organizační strukturu spolku, jeho jednotlivé orgány a osoby, které vykonávají funkci člena orgánu, a dále problematiku pobočného spolku.

Abstract:

The diploma thesis deals with the possibilities of law of associations to regulate its internal governance. The problem is viewed in the context of “autonomy of associations” and the limits laid down by mandatory provisions of the Civil Code. The thesis focuses on the organizational structure of the association and its various institutions and persons that perform the function of a body member, and the issue of branch association.
