Protective Measures for Importation into the EU

Abstract:

Tato bakalářská práce „Ochranná opatření při dovozu do EU“ zkoumá efektivnost a spravedlivost ochranných prostředků při dovozu ze třetích zemí uložených Evropskou unii. Teoretická část se zabývá přehledem ochranných opatření, relevantní legislativy a snaží se nastínit průběh procesu zavádění ochranných opatření. Výzkum probíhá prostřednictvím analýzy případové studie dumpingového dovozu z Čínské lidové republiky a vyhodnocuje signifikantní pokles v efektivnosti obchodu, což překvapivě nastalo ve fázi, kdy byla stížnost proti dumpingovému dovozu podána. Proto usuzuji, že hrozba uložení cla a dohled nad dovozními trendy jsou důvodem, proč společnosti přehodnotily své vývozní strategie. Po evaluaci relevantní legislativy, vědecké literatury a situaci z reálného života jsem usoudila, že ochranná opatření jsou pozůstatkem protekcionistické obchodní politiky.

Abstract:

This bachelor thesis “Protective Measures for Importation into the EU” examines the efficiency and the righteousness of protective measures imposed by the European Union on imports originating in third countries. The theory part provides a general overview of protective measures, relevant legislation and gives an indication of a protective measures imposition procedure. Using a case study of dumped imports from the People’s Republic China, the research finds a significant decline in the trade effectiveness, which surprisingly appeared already when a complaint against dumped imports was launched. Therefore concluding that a threat of tariffs imposition and surveillance over import trends cause companies to revaluate their export strategies. Having evaluated relevant legislation, scientific literature and real-life situation I conclude that safeguard measures are a remainder of the protectionist trade policies.
