Position of consumer and his legal protection

Abstract:

Bachelor thesis indicates the importance of consumer protection. It points to an unaccetable conditions of consumer contracts. It consists of three chapters. Bachelor thesis draws an expertise of consumer law of slovak and european legislation at a theoretical level. The first chapter focus on legislative regulations of consumer protections. There is a survey of the past and present of these legislative regulations. The second chapter focus on a consumer contracts at the level of contractual relations and an unacceptaple conditions of consumer contracts. There you can also find more discussions about the most common types of sales, such as doorstep and custom sales and online sales through e-commerce and on-line stores. We would like to propose solutions to eliminate contracts that contains unacceptable conditions in 3rd and final chapter. These solutions are offered to consumers, also it selects appropriate procedures in the preparation of proposals of consumer contracts for business entities, which deal in selling goods and services.

Abstract:

Bakalárska práca poukazuje na významom ochrany spotrebiteľa pri uzatváraní zmlúv s poukazom na takzvané neprijateľné podmienky. Rozdelená je do troch kapitol. V teoretickej rovine sa opiera o odborné poznatky z oblasti spotrebiteľského práva v slovenskej a európskej legislatíve. V prvej kapitole sa zamerala na legislatívne predpisy ochrany spotrebiteľa. Mapuje ich históriu a súčasnosť. V druhej kapitole rozoberá spotrebiteľské zmluvy v rovine uzatvárania zmluvných vzťahov, neprijateľných podmienok a ochrany spotrebiteľa pri uzatváraní zmlúv. Bližšie pojednáva o najrozšírenejších typoch predaja t.j. podomový a zákazkový predaj a internetový predaj prostredníctvom e-shopov a elektronických domov. V záverečnej tretej kapitole si dovoľujeme navrhnúť riešenia na eliminovanie zmlúv, ktoré obsahujú neprijateľné podmienky. Tieto riešenia ponúka jednak spotrebiteľom a zároveň vyberá vhodné postupy v procese prípravy návrhov spotrebiteľských zmlúv pre podnikateľské subjekty poskytujúce predaj tovarov alebo služieb.
