Regulation and Taxation of Virtual Currencies in the Countries of the European Union

Abstract:

Rigorózní práce „Regulace a zdanění virtuálních měn v zemích Evropské unie“ se zabývá identifikací existujících předpisů i vyjádřením příslušných orgánů, regulujících toto nové odvětví a následnou analýzou jejich dopadů v praxi. První část práce vymezuje základní pojmy a souvislosti virtuálních měn, blockchainu a distribuované účetní knihy s jejich příslušnými spojitostmi. Vzhledem k jejich opodstatnění jsme také zahrnuli otázky těžby kryptoměn, initial coin offering (veřejné nabídky virtuálních měn) a základní přístupy ke kvalifikaci tokenů. Využívá se tady metoda indukce, dedukce, komparace a analýzy. Druhá část práce je již zaměřená na využívání základních pojmů, jenž jsme si vymezili v první části, zaměřujíc se na identifikaci existujících právních předpisů, rozhodnutí, vyjádření a interpretace příslušných národních orgánů zemí Evropské unie, které regulují virtuální měny. Daná část práce byla rozšířena o interpretaci existující daňové úpravy v souvislosti s virtuálními měnami vzhledem ke skutečnosti, že daňové předpisy jednotlivých zemí (až na výjimky) nezohledňují tyto nástroje. V závěru naše práce poskytuje i konkrétní doporučení pro připravovanou regulaci v zájmu využití výhod nového odvětví i efektivnějšího výběru daní.

Abstract:

The “Regulation and Taxation of Virtual Currencies in the Countries of the European Union“ thesis focuses on the identification of existing legal rules and statements of respective authorities, regulating this new industry, as well as on the subsequent analysis of their impacts in practice. First part of this work defines the fundamental terms and basis of virtual currencies, blockchain and distributed ledger and their mutual interconnections. With regard to its importance, we have also included the issue of cryptocurrency mining, initial coin offering and basic approaches towards tokens’ qualification into the thesis. The method of induction, deduction, comparison and analysis is being applied therein. Second part of thesis is focused on the utilization of fundamental terms, we have defined in the first part, focusing on the identification of existing legal rules, decisions, statements and interpretation of respective national authorities of the EU countries, regulating virtual currencies. Respective part of this thesis was extended by an interpretation of existing tax rules with regard to virtual currencies, considering the fact that the tax rules of respective member countries (with some exceptions) do not even specify these instruments. In the conclusions of this theses, we provide certain recommendations for the prepared regulation of virtual currencies for the purpose of utilization of advantages of new industry and more effective tax collection.
