The purpose of the punishment in the Czech criminal law

Abstract:

Rigorózní práce pojednává o trestu, jeho významu a účelu v českém právu trestním z pohledu ústavních, zákonných i podzákonných norem trestního práva, z pohledu judikatury Ústavního soudu ČR a Nejvyššího soudu ČR a rovněž z pohledu teoretické nauky právní. Práce rozebírá jednotlivé tresty udělované na základě Trestního zákoníku a jejich postavení v českém systému trestání. Opisuje rovněž funkce trestu u sankcionování mladistvých pachatelů a dětí a stručně se zamýšlí nad důležitostí individualizací trestních sankcí s ohledem na funkci, kterou mají plnit a nad způsobem, jakým by trest měl být vykonán, aby měl největší šanci dosáhnout svého účelu. Práce se dále věnuje institutům trestní odpovědnosti právnických osob, dohody o vině a trestu, promlčení výkonu trestu a institutu zániku trestní odpovědnosti, a to z pohledu účelu trestu.

Abstract:

The rigorous thesis deals with the punishment, its importance and purpose in the Czech criminal law from the point of view of the constitutional legal acts, other regulatory legal acts and subordinate legal acts and jurisprudence of the Constitutional Court of the Czech Republic, High Court of the Czech republic and the legal theory. The thesis describes individual punishments imposed in agreement with the criminal code and their position in the Czech system of sanctions. It also describes the purpose of the punishments imposed upon juveniles and children and briefly deals with the importance of the individualisation of the punishments with regard to the purpose, which the punishment should follow. It also deals with the judicial institutes of criminal capacity of legal entity, agreement on guilt and punishment, limitation and extinction of criminal liability.
