Abstract:

Diplomovou práci „Dohody o pracích konaných mimo pracovní poměr a návrh na jejich novelu v zákoníku práce“ tvoří dvě části: teoretická a praktická. Práce se zaměřuje na zaměstnance pracující na dohody o pracích konaných mimo pracovní poměr a agentury práce. Teoretická část se věnuje otázkám historického vývoje dohod o pracovní činnosti, dohod o provedení práce a také agentur práce. Tato závislá činnost patří mezi prekérní pracovněprávní vztahy. Dále práce popisuje současnou legislativu těchto pracovněprávních vztahů. Je zde kladen důraz na pochopení jejich významu a zneužívání těchto smluv, procesu uplatnění a následného měření rozsahu. V praktické části je statisticky vyhodnocen a popsán výskyt těchto smluv v České republice z celkové zaměstnanosti. Tato analýza vychází ze statistických údajů za období od roku 1993 až do roku 2012. Údaje jsou rozděleny na obecnou statistiku, kde jsou vyměřeny z celkové zaměstnanosti, dále na tento výskyt formy zaměstnanosti u žen a mužů. Obecně lze říci, že dochází k nárůstu těchto prekérních pracovněprávních vztahů. Tato fakta umožní stanovení dalších kroků k řešení této problematiky zaměstnanosti. Vše bude shrnuto v závěru. Závěr potvrzuje, že dané hypotézy byly správné a zároveň by bylo potřeba toto prekérní zaměstnávání legislativně upravit nebo zrušit, aby nedocházelo k nárůstu tohoto nejistého a znevýhodněného zaměstnávání, které nejčastěji využívají agentury práce.

Abstract:

This thesis, that called „Agreement about the executed works out of the employment and the proposed amendment of the labour code“ is created from two parts, which are the theoretical and practical part. The thesis is focused at workers, who are working on basis of employment agreement and at works being executed out off employment plus at employment agencies. The theoretical part is dedicated to questions of historical development of employment agreement, agreements about executed works and also to employment agencies. This dependant activity belongs among sensitive labor relations. It describes further on the current legislation of labor relations. It emphasis on understanding of its meaning and misusing of those agreements. It emphasis also on proces of application and follow up in measurement of the range. In the practical part is statisticaly evaluated and described the proportion occurence of those agreements in the Czech republic of total employment. This analysis is derived from statistical figures from period of years 1993 – 2012. These figures were split at general statistic and then at proportion of participation of men and women of total. There can be generally said, that the ratio of occurance of those labor relationships is growing. Those facts will enable to set up follow up steps in order to sort out this issue in employment. All has been summarized in conclusion. The conclusion confirms, that the given hypotesis were right and it is needed either to regulate this kind of employment or to cancell it in on order to avoid growth of unsecure and disadvantaging employment, that is mostly being used by employment agencies.
