Legal Situation of Functionnaires, Officers and Employers of the European Unio and of Related Institutions

Abstract:

V této diplomové práci se zabývám postavením zaměstnanců, úředníků a funkcionářů v orgánech a institucích Evropské unie. V úvodu práce je obecně vymezena struktura mezinárodní organizace, zejména jejího administrativního aparátu, s charakteristikou jejích zaměstnanců. Pro možnost následného srovnání s postupy EU se v úvodu rovněž okrajově zabývám charakteristikou největší mezinárodní organizace v roli zaměstnavatele - Organizací spojených národů. Hlavní náplní diplomové práce je vymezení subjektů v rámci EU zaměstnávající jednotlivce, rozbor jednotlivých kategorií zaměstnanců, problematika výběrových řízení, problematika diskriminace ze strany orgánů EU. Dále je v práci věnována pozornost pracovním podmínkám zaměstnanců, systému odměňování a danění výdělků, sociálnímu zabezpečení zaměstnanců a jejich rodinných příslušníků. V závěru práce je dán prostor disciplinárnímu právu zaměstnanců a systému řešení zaměstnaneckých sporů. V poslední kapitole je komparováno postavení úředníků EU s postavením úředníků v české státní správě.

Abstract:

In this thesis I deal with the status of employees, functionaries and officers, in the bodies and institutions of the European Union. The introduction presents the general structure of the international organization, in particular of its administrative apparatus, with the characteristics of its employees. For the possibility of a subsequent comparison with the EU practices, I also deal marginally with the largest international organization playing the role of an employer - the United Nations Organization. The main tasks of the thesis are: to identify the entities within the EU employing individuals, to analyze each category of employees, to deal with tenders and issues of discrimination by the EU institutions. The thesis also pays attention to working conditions, remuneration and taxation of earnings, as well as social security of employees and their family members. The final part of the thesis describes applicable disciplinary law and the employment dispute resolution system. The final chapter compares the position of EU officials with the position of officials in the Czech state administration.
