Abstract:

Tato diplomová práce se zabývá problematikou přímé aplikovatelnosti mezinárodních smluv, tzv. self-executing treaties. Ve svém úvodu se stručně zabývá vztahem mezinárodního a vnitrostátní práva. Vzhledem k zaměření práce na právní systém Spojených států, jsou popsány nejdůležitější články americké Ústavy vztahující se ke vztahu mezinárodních smluv a vnitrostátního práva s důrazem na Supremacy Clause, jež zde hraje zásadní roli. Značná část práce je věnována rovněž hlavním soudním rozhodnutím, jež formovaly doktrínu self-executing smluv v americkém právním prostředí a rozboru několika přístupů k této doktríně. Poslední část práce je věnována případu Madellín v. Texas, soudnímu rozhodnutí zabývající se problematikou self-executing smluv jako praktického příkladu toho, jakým signifikantním způsobem tato teoretická koncepce ovlivňuje možnosti aplikace mezinárodní smlouvy a tím výsledek soudního řízení a možnosti přiznání individuálních práv jednotlivci.

Abstract:

This diploma thesis deals with the issue of self-executing treaties. At the beginning it briefly concerns with a relationship between international law and national law. Considering the focus of this thesis on United States legal system, there are described the most important clauses of the United States Constitution related to relationship between international treaties and national law with an emphasis to Supremacy Clause, which has the most crucial role here. Considerable part of thesis is devoted to the most essential precedents, which formed doctrine of self-executing treaties in the United States legal system and analysis of some approaches to this doctrine. Last part of this thesis is devoted to Madellín v. Texas case, judicial decision dealing with the issue of self-executing treaties as a practical example of how significantly can this theoretical theory influence application of treaty and therefore outcome of a proceeding and a possibility of granting individual rights to a natural person.
