Abstract:
Diplomová práce se zabývá mimořádným opravným prostředkem, jakožto obnovou řízení. Autorka v práci mapuje aktuální právní úpravu tohoto institutu a snaží se ho porovnat se slovenskou právní úpravou. Část práce se též věnuje návrhům de lege ferenda a náhradě škody v občanskoprávním řízení. Diplomová práce převážně vychází z judikatorního výkladu.
Abstract:
This thesis is focused on extraordinary remedy, i.e. retrial in criminal proceedings. The author charts the current Czech legislation of this institute and try to compare with the Slovak regulation. Part of thesis summarizes the legislative improvements and possible effects of civil proceedings.This thesis is based on judicial interpretation.
