Critical Analysis and Perspectives of Legal Regulation of Interim Measures

Abstract:

Tématem této diplomové práce je právní úprava předběžného opatření. Kapitoly, kromě první, se věnují kritické analýze problematických ustanovení občanského soudního řádu ve vztahu k předběžnému opatření. První část této diplomové práce je krátký historický exkurs. Práce obsahuje výhledy právní úprava. Tyto výhledy by potencionálně mohly nahradit problematická ustanovení současné právní úpravy. Cílem této práce je navrhnout právní úpravu předběžného opatření. Tato úprava by měla být precizní a vhodná pro právní řád České republiky.

Abstract:

Topic of this master thesis is legal regulation of interim measure. Chapters, except the first, focus on the critical analysis of problematical regulation of the Civil Procedure Act in relation to interim measures. The first chapter of this master thesis is brief historical guide. Thesis contains perspectives of legal regulation. These perspectives could potentially replace problematical provision of current legal regulation. The aim of this thesis is to suggest legal regulation of interim measure. This legal regulation should be precise and suitable for legal order of the Czech Republic.
