The Role of Penalty and Punishment in the Context of New Criminal Code. Philosophical and Legal Analysis of the Problem

Abstract:

Tato diplomová práce se zabývá účelem a funkcemi trestu v postindustriální společnosti. Nejprve je o účelu trestu pojednáno v rámci teorií trestání. Poté je účel trestu popsán prostřednictvím systémového přístupu. Práce také pojednává o ideologickém popisu účelu trestu v trestním kodexu z období socialismu. Dále se práce zabývá funkcemi trestu. Tyto funkce trestu jednak definuje a poté je srovnává s účelem trestu. Pojednává také o spravedlivém trestu. Po těchto obecných úvahách je tato problematika situována do zákona č. 40/2009 Sb., trestního zákoníku, ve znění pozdějších předpisů. Konec práce je zaměřen na obecné úvahy o alternativních trestech. Cílem této práce by mělo být zhodnocení současného pojetí účelu trestu po přijetí zákona č. 40/2009 Sb., trestního zákoníku, ve znění pozdějších předpisů.

Abstract:

This diploma thesis deals with purpose and function of the punishment in the industrial society. Firstly talks about purpose of punishment in framework of theories of punishment. Then the purpose punishment in framework of system approach. Thesis also concerns with ideological description of purpose of punishment in criminal code in socialism. Then thesis deals with function of punishment. This function defines and then it compares with the purpose of punishment. Thesis also talks about just punishment. After these general consideration these issues are focused on act No. 40/2009 Coll., penal code, in following version. Finally this diploma deals with general considerations of alternative punishments. Aim of this thesis is assessment of actual conception of purpose of punishment after enactment of act No. 40/2009 Coll., penal code, in following version.
