Relations between CZ and SK in the field of pension insurance

Abstract:

Práce uvádí do problematiky provádění Smlouvy mezi Českou republikou a Slovenskou republikou o sociálním zabezpečení. Poukazuje na její praktické dopady na jednotlivé kategorie osob v oblasti důchodového pojištění a na následný vývoj judikatury ve výše uvedené oblasti. První kapitola se zabývá rozdělením společného státu a následným vývojem právních předpisů v oblasti sociálního zabezpečení v obou státech. Druhá kapitola obsahuje rozbor stěžejních článků Smlouvy mezi Českou republikou a Slovenskou republikou o sociálním zabezpečení. Třetí kapitola se zabývá dopady práva Evropských společenství do provádění výše uvedené Smlouvy po vstupu obou států do Evropské unie. Čtvrtá kapitola se věnuje konkrétní kauze zaměstnanců Československých státních drah. Pátá kapitola se zabývá nálezem Ústavního soudu České republiky, který se týká aplikace Smlouvy mezi Českou republikou a Slovenskou republikou o sociálním zabezpečení. Šestá kapitola se věnuje řízení o předběžné otázce u Evropského soudního dvora právě ve věci aplikace Smlouvy po vstupu ČR a SR do EU. V závěru je uvedena úvaha o tom, zda kritérium, které bylo dohodnuto Českou republikou a Slovenskou republikou při jednání o rozdělení nákladů na důchody za dobu zabezpečení získanou v bývalém Československu a které bylo zapracováno do článku 20 Smlouvy o sociálním zabezpečení, bylo vůbec správné.

Abstract:

This work presents the implementation issues of the Agreement between the Czech Republic and the Slovak Republic on Social Security. It refers to the practical impacts on different categories of people in the area of pension insurance and the subsequent development of law in the above mentioned areas. The first chapter deals with the dissolution of the Czechoslovak federation and subsequent legislative developments in the field of social security in both countries. The second chapter analyzes the key articles of the Agreement between the Czech Republic and the Slovak Republic on Social Security. The third chapter describes the impact of the European Communities law on the implementation of the aforesaid Agreement after both countries joined the European Union. Fourth chapter explains a specific case of the Czechoslovak State Railways employees. The fifth chapter deals with the decision of the Constitutional Court of the Czech Republic, involving the application of the Agreement between the Czech Republic and the Slovak Republic on Social Security. The sixth chapter analyzes the preliminary ruling before the European Court of Justice application of the Agreement after both countries joined the EU. Finally, consideration is given to whether a criterion which was concluded by the Czech Republic and the Slovak Republic when negotiating the division of the pension payment costs for insurance period completed in former Czechoslovakia and which was incorporated in Article 20 of the Social Security Agreement was not correct.
