Interest representation and advocacy of the Czech Republic in proceedings before the Court of Justice of the EU

Abstract:

Magisterská práce se věnuje problematice zastupování a prosazování zájmů České republiky v řízeních před Soudním dvorem EU. Staví na základních východiscích teorií evropské integrace, které doplňuje o teoretický model „vlivu prostřednictvím litigace“. Na základě tohoto modelu můžeme jednotlivé aktéry v řízeních před Soudním dvorem EU rozdělit na tzv. opakované hráče a jednorázové střelce. V návaznosti na tento teoretický koncept se tak předkládaná práce pokouší odpovědět na otázku: Jakého aktéra v řízeních před Soudním dvorem EU představuje Česká republika? V této souvislosti je pak analyzováno institucionální nastavení zastupování, zvolená strategie prosazování zájmů, jakož i dosavadní aktivita ČR v řízeních před Soudním dvorem EU.

Abstract:

The thesis deals with the interest representation and advocacy of the Czech Republic in proceedings before the Court of Justice of the EU. It draws on basic foundations of the theories of European integration, which are completed by the theoretical model of “influence through litigation”. On basis of this model two possible actors in proceedings before the Court of Justice of the EU could be defined – Repeat Players and One-Shotters. With regard to this theoretical concept the following question is going to be answered: What kind of actor does the Czech Republic represent in proceedings before the Court of Justice of the EU? In this respect such aspects as the institutional setting of the representation, chosen strategy of interest promotion and existing activity of the Czech republic before the Court of Justice of the EU are going to be analyzed.
