Sanctioned in administrative proceedings

Abstract:

Work deals with sanctioned in administrative proceedings. We tried to point out the difference between administrative proceedings and infringement procedure. We tried to point out what the difference is between these two procedures characterization methodology. The thesis is divided into three parts. The first part focuses on the concept of administrative law, the subdivision explanation administrative standards and sources of administrative law. We then discussed the administrative procedure, its progress and penalties awarded in this proceeding. We clarify the notion of an administrative offense, of course, his division. In the second part of the thesis we deal with infringement procedure, its characteristics, identifying the offense, block and commanded procedure and we clarify the concept of fine and violation. In the third section we have placed on the player fined a number of offenses per 2012 in the district Brezno, was mainly about traffic violations. Additionally, we focused on the public survey, using a questionnaire, which we mentioned in the tables and graphs.

Abstract:

Bakalárska práca sa zaoberá sankciovaním v správnom konaní. Snažili sme sa poukázať na rozdiel medzi správnym konaním a priestupkovým konaním. Snažili sme sa upozorniť na to, aký rozdiel je medzi týmito dvoma konaniami metodikou charakterizácie. Bakalárska práca je delená na tri časti. Prvá časť je zameraná na pojem správne právo, jeho delenie, vysvetlenie správnych noriem a prameňov správneho práva. Následne sme rozoberali správne konanie, jeho priebeh a sankcie udelené v tomto konaní. Objasnili sme pojem správny delikt, samozrejme aj jeho delenie. V druhej časti bakalárskej práce sme sa zaoberali priestupkovým konaním, jeho charakteristikou, identifikáciou priestupku, blokovým a rozkazným konaním a objasnili sme pojem pokuta a priestupok. V tretej časti sme uviedli na základe štatistík udelené pokuty a počty priestupkov za rok 2012 v okrese Brezno, jednalo sa hlavne o dopravné priestupky. Dodatočne sme sa zamerali na prieskum verejnosti, prostredníctvom dotazníka, ktoré sme uviedli v tabuľkách a grafoch.
