Contract for Work in Commercial Law in View of Project Guarantee

Abstract:

Nosným tématem bakalářské práce je problematika uzavírání smlouvy o dílo v obchodním právu z pohledu realizace stavby a následné záruky. V teoretické části budou rozebrány jednotlivé právní předpisy, související s tématem bakalářské práce a také jednotlivá smluvní ustanovení jako je vymezení smluvních stran, předmětu díla, jeho ceny a dalších s důrazem kladeným zejména na vady, nedodělky a záruční podmínky. V praktické části bude provedena analýza stavební společnosti RD Rýmařov s.r.o., spočívající v popisu jednotlivých projektů společnosti a následném rozboru standardní smlouvy o dílo společností uzavírané. V dalších částech práce bude provedeno zhodnocení smluvních nedostatků a jejích hlavních příčin. Závěrem práce bude návrh optimálního postupu uzavírání smluv, vyřizování reklamací, vad a nedodělků.

Abstract:

The Bachelor Thesis is concerned with the concluding of the Contract for Work in the business law regarding building construction and consecutive guarantee. Theoretical part of the thesis deals with the relevant legislation and the articles of agreement, such as determination of contracting parties, subject of the work and its price, where as the biggest emphasis is placed on defects, arrears and guarantee conditions. The analysis of the building company RD Rýmařov s.r.o. is the main subject of the practical part of the thesis. The analysis comprises the description of particular company's projects and the consequent study of the standard contract for work concluded by this company. Following parts of the thesis consider contract deficiencies and their main reasons. The optimal process regarding concluding of the contracts, settling the claims, defects and arrears is involved in the conclusion of the thesis.
