Legal Status of Nationals of Non-Memberstates in the EU

Abstract:

Předkládaná diplomová práce se zabývá právním postavením cizinců v EU. Zaměřena je nejen na jejich jednotlivá práva, ale také na otázky právního rámce migrační politiky a azylu. Nejvíce práv je přiznáno trvale pobývajícímu rezidentu, proto katalog práv, kterým se práce zabývala, vychází ze směrnice Rady 2003/109/ES. Jednotlivá práva jsou demonstrována na české právní úpravě. Závěr práce obsahuje doplňková práva, která jsou upravena na unijní úrovni a to právo na zaměstnání, vzdělání a sociální zabezpečení.

Abstract:

This thesis deals with the legal status of foreigners in the EU. It is focused not only on their individual rights, but also on the question of the legal framework of migration policy and asylum. Most rights are granted to a permanent resident therefore the catalogue of rights, which this thesis deals with, is based on Directive No. 2003/109/ES. Individual rights are demonstrated on Czech legislation. The final chapter of this thesis contains additional rights which are regulated at the European Union level. These are the right to employment, education and social security.
