Interrogation of a child in a special interrogation room

Abstract:

Abstrakt Bakalářská práce obsahuje obecnou charakteristiku výslechu, jeho pojmy a popisuje průběh procesu výslechu, kam patří příprava, stádia a techniky výslechu. Zaměřuje se na děti spíše nezletilé, u kterých je prováděno individuální zacházení a jejich výslech má odlišné podmínky od ostatních. Rozvádí psychologické aspekty a zvláštnosti výslechu dítěte, zejména z možného negativního dopadu na duševní vývoj dítěte, kdy příčinou může být nesprávné provedení výslechu, nezkušenost nebo nevhodné chování a vyjadřování vyslýchajícího. V této práci je také obsažen vzhled a účel speciální výslechové místnosti a poukazuje na technické prostředky, vybavení a pomůcky, které se využívají při tomto vyšetřovacím úkonu. Cílem závěrečné práce je rozbor výslechu, jež je kriminalistickou metodou, a analýza psychologických a právních aspektů výslechu dětí. Zároveň popisuje účel speciální výslechové místnosti, která je nejčastěji spojována s výslechem zvlášť zranitelných obětí, mezi něž právě patří i dítě. Uvádí také způsoby správného zacházení s dítětem, aby výslech směřoval k získání úplné a věrohodné výpovědi.

Abstract:

The bachelor thesis is devoted to not only analysis of general process of interrogation, but it´s key theme leading interrogation of children. It involves generally characteristics of an interrogation, it´s terms and describes the process going of the interrogation as is preparation, stages and technics of interrogation. It mentions children here, rather minors, which have individual treatment and it´s interrogation has different conditions than others. It deliberate psychological aspects and dissimilarities of the child´s interrogation, especially is here mention about possible negative impact on mental health process of the child, when cause can be incorrectly performance of interrogation, inexperience or inappropriate behavior and expression coming from interrogating staff member. In this thesis also includes design and meaning of special interrogation room and it point´s on technical resources, equipment and aids that are used for the action. This room is mainly connecting and identified for child´s interrrogation, because the act has to be united in with the law and child´s law. The purpose of this final work is pointing for importance of correct treatment with child, so the interrogation can retrieve an full and credible testimony. The thesis is also occupied with possible risk of manipulation of child and imaginary border between interrogation of children and interrogation of juvenile.
