Miloš Zeman: Presidential Type of Governance in Parliamentary System

Abstract:

Miloš Zeman byl prvním a druhým přímo zvoleným prezidentem ČR. Ve své bakalářské práci se zaměřím na faktickou proměnu prezidentského úřadu. Budu zkoumat některé prezidentovy výroky, kterými poškodil jak úřad, tak svou osobu, tak i jeho konkrétní kroky, kterými podle mého názoru překročil ústavní rámec svých pravomocí. Na to naváži interpretací pokusu o ústavní žalobu, která sice byla Parlamentem ČR zamítnuta, nicméně budu se snažit zdůvodnit, proč by Ústavní soud, pakliže by se k rozhodování dostal, mohl případně rozhodnout o prezidentově porušení ústavy.

Abstract:

Miloš Zeman was the first and second directly elected president of the Czech Republic. In my bachelor thesis I will focus on the actual transformation of the presidential office. I will examine some of the president's statements that have damaged both the office and his person, as well as his specific actions that, in my opinion, have exceeded the constitutional scope of his powers. I will follow this up by interpreting the attempted constitutional action, which although rejected by Parliament, I will nevertheless attempt to justify why the Constitutional Court, if it were to reach a decision, could possibly rule on the President's violation of the Constitution.
