Recognition in Criminalistics

Abstract:

Tato bakalářská práce je zaměřena na problematiku rekognice jako metody kriminalistické praktické činnosti, s níž se setkáváme v rámci trestního řízení. Jsou zde zohledněny jak kriminalistické tak i trestněprávní a psychologické aspekty. První část této práce se věnuje obecnému vymezení a charakteristice rekognice, její psychologické stránce a jejímu historickému vývoji. Také v ní uvádím některé ze současných problémů, které judikatura řeší. Stěžejní část této práce je pak zaměřena na rekognici osob, která v praxi vzbuzuje nejvíce otázek a s níž je spojena řada chyb, které se při jejím provádění objevují. V průběhu této práce zároveň vyjde najevo, že ačkoliv se rekognice může jevit jako jednoduchý úkon, její příprava a realizace klade na orgány činné v trestním řízení nemalé nároky.

Abstract:

This thesis is focused on the issues of recognition as a forensic practice that we encounter in criminal proceedings. Both criminalistic, criminal law and psychological aspects of recognition are taken into account. The first part of this thesis is devoted to the general definition and characteristics of recognition, its psychological aspects and to its historical development in which I also mention some of the current problems that the case law addresses. The main part of this work is focused mainly on the people recognition which in practice raises the most questions and with which there are a number of errors that occur in its implementation. In the course of this work also becomes clear that, although recognition may seem like a simple act, its preparation and implementation place considerable demands on law enforcement authorities.
