Forest land Concept in Comparison with the Land Devoted to Fulfill Functions of the Forest

Abstract:

Cílem této závěrečné práce je vymezení pojmu lesní pozemky ve srovnání s pozemky sloužící plnění funkcí lesa, analýza uvedených pojmů, vymezení pramenů právní úpravy, ze kterých definice uvedených pojmů vychází. Les patří k nejpozoruhodnějším a nejsložitějším ekosystémům naší planety. Je dominantou krajiny, resp. tuto krajinu svoji přítomností často nezaměnitelně utváří. Les není pouhým producentem dřevní hmoty, ale zastává i další důležité funkce jako jsou například funkce půdoochranná, vodohospodářská, rekreační, klimatická a další. Pro tyto mimoprodukční funkce je třeba zvýšená ochrana lesa ve veřejném zájmu. Nutnost ochrany lesa si uvědomovali i autoři prvních lesních řádů a zákonů. Proto do těchto předpisů často zapracovávali ochranu lesních porostů i lesní půdy. Pojmům lesní pozemek a pozemek určený k plnění funkcí lesa se podrobným způsobem věnuje zákon číslo 289/1995 Sb., o lesích, ve znění pozdějších předpisů. Tento právní předpis přesně určuje v rámci pozitivní i negativní definice, co je a co není pozemek určený k plnění funkcí lesa, co je pozemek lesní a co znamená termín jiný pozemek. Lesní zákon také stanoví jakým způsobem jsou chráněny pozemky určené k plnění funkcí lesa, za jakých podmínek a jakým způsobem je možné u pozemku odejmout či omezit plnění funkcí lesa. Druhým důležitým právním předpisem je zákon číslo 344/1992 Sb., o katastru nemovitostí České republiky (katastrální zákon), znění pozdějších předpisů resp. jeho prováděcí vyhláška 26/2007 Sb., V této vyhlášce je definován lesní pozemek stejným způsobem jako v zákoně o lesích. Pojem pozemky určené k plnění funkcí lesa se pak v katastrální vyhlášce objevuje jako typ a způsob ochrany nemovitosti. Problémem může být neprovázanost mezi tímto typem a druhem ochrany nemovitosti a nelesními druhy pozemků, které dle definice v lesním zákoně spadají pod pozemky určené k plnění funkcí lesa. Závěr práce se věnuje příkladu z praxe, převodu druhu pozemku ze zemědělské půdy na les z důvodu zalesnění

Abstract:

The main purpose of this work is the comparison of the forest parcels with the parcels determined for fulfilling the functions of the forest. The further analysis decribes all of the mentioned terms and determines the legal form resources, from which the conception comes-out. We might consider the forest as one of the most remarkable and most difficult ecosystem of our planet. It is a dominant of a landscape or let us say it often shapes the landscape because of its unmistakable and incommutable presence. The forest is not only a producer of libriform masses but serves other important functions as well, for example soil-preventing, aquiculturing, recreational, climatic and other related functions. Because of these off-produce functions, the incerased protection of forests is necessity in the public interest. The necessity of protection the functions in forests was also considered by the authors of the first forest rules and laws. Therefore the authors were often ripening the preservation of wood growths and forest soil at the same time. The law issue 289/1995 sb. distinguishes in details the exact diference between the forest parcels, the parcels determined for fulfilling the functions of the forest and other parcels. This forest law determines exactly in a negative and even in a positive way the definition, what is and what is not the parcel determined for fulfilling the functions of the forest, the forest parcel and what we mean by the title "another parcel". The forest law also sets in what way are the parcel determined for fulfilling the functions of the forest protected,under which conditions it is possible to take take away or limit the fulfilling the functions of the forest. The second very important law is the law issue 344/1992 Sb. concerning the land register real property of Czech Republic or his execute promulgation 26/2007 Sb.. There is a same definition of a forest parcels as in the forest law. The term "parcels determined for fulfilling the functions of the forest" appears then as a type of protective way of estate. The problem might be in a no cohesion between this type of preservation of estate and nonforest kinds of parcels, which are according to the definition in the forest law determined as the parcels determined for fulfilling the functions of the forest. The conclusion of the work paies attention to the example from an experience, the transmission of the parcel from the agricalture soil to the forest on the ground of afforestation.
