Top Czech Courts and the Case Law of Human Rights Bodies (excluding ECtHR)

Abstract:

Cílem této diplomové práce je provést analýzu odkazů na činnost kvazisoudních orgánů na úrovni OSN v judikatuře Ústavního soudu, Nejvyššího správního soudu a Nejvyššího soudu v letech 1993 až 2014. Konkrétně se pak jedná o následující výbory: Výbor pro lidská práva, Výbor proti mučení, Výbor pro práva dítěte, Výbor pro odstranění všech forem diskriminace žen, Výbor pro odstranění všech forem rasové diskriminace, Výbor pro hospodářská, sociální a kulturní práva, Výbor pro práva osob s postižením, Výbor pro migrující pracovníky a Výbor pro nucené mizení. Práci lze pak rozdělit na část teoretickou a praktickou. Teoretická část práce se pak zpočátku zabývá postavením mezinárodních smluv o lidských právech a rozhodnutí kvazisoudních orgánů v českém právním řádu. Účelem praktické části práce je ve výsledku zjistit počet těchto odkazů na činnost kvazisoudních orgánů a jejich strukturu. Konečně by pak práce měla poukázat na některé problémy, s nimiž se lze setkat při práci českých soudů s rozhodnutími a obecnými komentáři těchto kvazisoudních orgánů v rámci jejich vlastní argumentace. Tato detailnější analýza je pak prováděna ve třech oblastech, v nichž se odkazy na činnost těchto kvazisoudních orgánů objevují nejčastěji. Konkrétně se pak jedná o restituční problematiku, problematiku rovnosti a diskriminace a problematiku práv dítěte. Závěr následně obsahuje zhodnocení množství těchto odkazů rovněž v porovnání s odkazy na judikaturu Evropského soudu pro lidská práva. Zde je poté obsažena rovněž úvaha nad důvody nedostatečné reflexe činnosti kvazisoudních orgánů a případné možnosti řešení.

Abstract:

The aim of this master’s thesis is to make an analysis of references to work of quasi-judicial bodies of The United Nations Organization in the practice of The Constitutional Court, The Highest Administrative Court and The Highest Court during years 1993 – 2014. It is focused on following committees: The human rights committee, The committee against torture, The Committee on the rights of the child, The committee on the elimination of discrimination against women, The committee on the elimination of racial discrimination, The committee on economic, social and cultural rights, The committee on the rights of persons with disabilities, The committee on migrant workers and The committee on enforced disappearances. This master’s thesis can be divided into theoretical and practical part. The theoretical part is focused on the position of international contracts of human rights and decisions of quasi-judicial bodies in Czech legal system. The main purpose of the practical part is to find the number of references to work of quasi-judicial bodies and its structure. Finally, this thesis should point out some issues that we can find in the area of work with decisions and general comments of these quasi-judicial bodies in their own argumentation. This detailed analysis is made in the three areas where we can find most of the references to work of quasi-judicial bodies. What specifically belongs to this area is the issue of property restitutions, issue of discrimination and equality and issue of rights of children. The conclusion then contains assessment of the amount of these references in comparison with references to the practice of The European Court of Human Rights. Furthermore, consideration of the reasons of deficient reflection of the work of quasi-judicial bodies and potential solutions are also included.
