The crime scene reconstruction

Abstract:

Tato bakalářská práce pojednává o specifické metodě kriminalistické praktické činnosti, a to o rekonstrukci trestného činu. Je rozdělena na teoretickou a praktickou část. V teoretické části je použita deskriptivní metoda a metoda analýzy. Jsou zde popsány základní zásady, které musí dodržovat orgány činné v trestním řízení, subjekty, které se tohoto úkonu účastní, příprava, která předchází samotnému provedení úkonu, dále je zde vysvětleno provedení, včetně taktických postupů, a je zde popsána i dokumentace a hodnocení rekonstrukce trestného činu. Jelikož je tato kriminalistická metoda zároveň důkazním prostředkem v trestním řízení, je zde obecně popsáno i dokazování v trestním řízení, včetně jeho základních zásad a základních pojmů této problematiky, jako jsou důkaz, důkazní prostředek a předmět dokazování. Z trestněprávního hlediska je rekonstrukce trestného činu zvláštním způsobem dokazování, proto i tyto jsou v bakalářské práci obecně popsány. Jedná se o konfrontaci, rekognici, prověrku výpovědi na místě a vyšetřovací pokus. Dále se práce zabývá dalšími druhy rekonstrukce v kriminalistice. Praktická část práce obsahuje výsledky anonymního dotazování příslušníků PČR, ohledně rekonstrukce trestného činu v praxi, konkrétně jaké je povědomí o této metodě, a zda a v jaké míře je využívána v praktické činnosti příslušníků PČR.

Abstract:

This bachelor thesis deals with specific method of criminalistics practical activity, with a crime scene reconstruction. Thesis is divided into theoretical and practical part. Descriptive and analytical methods are used in theoretical part of this thesis. There are described basic principles, which law enforcement authorities have to follow, subjects, which participate in this act, preparation, which precede the act itself, further there are explained an implementation including tactical procedures, and documentation and assessment of this method. As this criminal method is simultaneously means of evidence in criminal proceeding, there are described evidence in criminal proceedings in general, with basic principles and concepts of this problematic as evidence, means of evidence and subject of evidence. The crime scene reconstruction is one of the special methods of evidence from a criminal law point of view and therefore these are described in this thesis in general too. These methods are confrontation, recognition, verification of the statement at the scene, and investigative experiment. Furthermore this thesis deals with other types of reconstruction in criminalistics. Practical part includes results of anonymous questioning a members of the police of the Czech Republic, regarding crime scene reconstruction in practice, specifically what is general knowledge among the police force about this method, if it is used, and in what extent it is used in practical activity of members of the police of the Czech Republic.
