Abstract:

Tato bakalářská práce lze rozdělit na dvě části, teoretickou a praktickou část. Hlavním zaměřením teoretické části je porovnání přístupů teritoriality, universality a kontraktualismu v mezinárodním insolvenčním řízení. Dále rozebírám způsob řešení úpadku dlužníka-právnické osoby z pohledu evropského práva. V praktické části se zabývám aplikací evropského insolvenčního nařízení v souvislosti úpadku mezinárodní skupiny. Insolvenční nařízení použiji na reálný případ, s tím že otestuji domněnku o aplikovatelnosti insolvenčního nařízení.

Abstract:

The thesis is divided into two main parts, theoretical and practical. The aim of the former is to compare the approaches of teritorialismus, universalismus and cotractualismus in international insolvency proceedings. Another goal of the theoretical part is to describe European insolvency procedures from the point of view of a company. The practical part focuses on the application of European insolvency directive in the case of a group of companies. In this part, I also apply the directive to a real insolvency case, by which I test my assumption about application of the insolvency directive.
