Legislative process under the state of legislative emergency

Abstract:

Práce si klade za cíl zhodnotit legislativní proces ve stavu legislativní nouze na základě analýzy všech projednávaných návrhů zákonů v tomto institutu v Poslanecké sněmovně České republiky do konce roku 2013, navrhnout optimální legislativní změnu reflektující změny v jeho současné aplikaci v praxi a stanovit požadavky na projednávání návrhu zákona v této proceduře, aby byl naplněn smysl a účel tohoto mimořádného režimu zkracující legislativní proces.

Abstract:

The aim of this thesis is the evaluation of the Legislative process under the state of legislative emergency on the basis of analysis of the all draft bills discussed in the Parliament of the Czech Republic to the end 2013, propose an optimal legislative amendment reflective the modification in its contemporary application in practice and the determination a minimum requirements on the draft bills with clear respect to the content sense and purpose of this extraordinary legislative instrument.
