Abstract:

Práce se zabývá odčiněním nemajetkové újmy na zdraví a při usmrcení, a to z pohledu zákona č. 89/2012 Sb., občanský zákoník. Jejím cílem je proniknout do dané právní oblasti a poskytnout ucelený přehled o jednotlivých nárocích na náhradu nemajetkové újmy při ublížení na zdraví nebo usmrcení. Důraz bude kladem taktéž na problematické aspekty a nedostatky související s povahou nároku na odčinění újmy na zdraví, Metodiku Nejvyššího soudu k náhradě nemajetkové újmy na zdraví a nastolenou dvojkolejnost právní úpravy odčiňování újmy na zdraví v pracovním a občanském právu.

Abstract:

The thesis deals with the atonement of non-material damage to health and death from the perspective of Act No. 89/2012 Coll., Civil Code. Its aim is to penetrate into the legal area and provide a comprehensive overview of individual claims for compensation for non-material damage in the event of bodily harm or death. Emphasis will also be placed on the problematic aspects and deficiencies related to the nature of the claim for compensation for health injury, the Supreme Court Methodology for compensation for non-material damage to health and the established double-tracking of the legal regulation of health harm atonement in labor and civil law.
